Just as a heads up we are initiating step 1 of dealing with the MLX NCP consulatation by adding this footer on all pages all sites. Any other distributor feel free to use it. Off course if your applying for an MA from the MHRA you wont need to.


WARNING: the electronic cigarette will not cure a smokers addiction to nicotine, the electronic cigarette serves the same purpose as a tobacco cigarette- it delivers its user nicotine. If you do suffer from the disease of Tobacco/Nicotine Dependence Syndrome and want to take steps to give up smoking or cut down the quantity of cigarettes you currently smoke. We recommend you visit your health care provider to discuss NRT (Nicotine Replacement Therapy) or a nicotine harm reduction programme.

We are also in the process of finalising details that we believe have a rock solid chance of allowing all sellers to be selling their NCPs for recreational purposes, to still be selling un hindered after JUNE the 21st.

Sellers going for a medical license we agree should be banned from selling till their approval is received.

IE we agree to option 1 for all companies claiming medicinal purpose for their products.

So if i achieve what i expect only sellers who will be banned from selling will be companies that believe their products are medicinal the rest of us will be ok.

Lots of work to do but im happy i have a soloution..

We must remember that the MHRA deal with the disease of tobacco addiction not the fun of recreation.

Therefore Option 1 is a must for unlicensed medicinal NCPs.

IE any company who want their products used for NRT or harm reduction, then i agree it would be totally un-ethical for them to even consider selling to susceptible buyers who suffer from TDC (tobacco dependance Syndrome) in this we agree 100% with the MHRA.

I have received good legal counsel that because we are selling Electronic NCPs (recreational) and not Electronic NCPs (medicinal) like intelicig.

This will allow us to propose an ammendment to option 1...So fingers crossed Medicinal NCPs will be banned on the 1st June till their license is approved.

Recreational NCP sellers will then not be under the MHRAs remit. That is how it should be.

Off course i will work with the MHRA to make sure any diseased person entering my sites are directed to nicorette or relevant NRT or quit smoking help lines..

Mebbe not Toby - depends if the line about diseased smokers is going in as well...at any point.

'Diseased' is a hard word to swallow, but I guess it's legalise?

Please remember that Eissenberg's angle is to prove that ecigs do not deliver nicotine and he believes he has proved that in the cases of nJoy and Crown 7 - he found no nicotine delivery after following their instructions for use. So don't make unproven claims if you can.

I suggest something like - our products are not sold for therapy or medical use, they have not been tested for effectiveness or suitability to cure addiction and we sell them as recreational products only.

I've posted this once but I think it's worth repeating as its more 'on topic' here.

This won't effect suppliers with there own branded kit, unless they still include the OEM instructions. But there's not much point altering your site as per Jason's suggestions if the instructions in the kits are at odds with what the websites claim.

I'm going to go through my site and check it complies, add a footer (wording will differ) and write new instructions for all my kits this weekend.

I'm happy for the disclaimers to be issued with prejudice. If retailers aren't pharmaceutical companies, they're probably not wanting to set themselves up as diagnosticians.
