this website has recently been brought to the attention of the administrators of UK Vapers. Whilst we make no comment about the site itself, one thing that has caused concern is the fact that it has taken quotations from this site and reposted them as testimonials, as can be seen here.

We would like to assure all members that UK Vapers had no knowledge whatsoever about this having been done until it was brought to our attention, and neither have we granted permission to the website owner to reproduce the quotations

Following discussions among the staff of UK Vapers, we believe that ownership of the individual quotations lies with the original author and would recommend that anyone who is not happy with their name and / or quotation being associated with this site should contact the site owner and request that their quotation be removed

If you have any questions or concerns about this, please do not hesitate to contact one of the administrators or moderators

Very cheeky to "pinch" comments like that without at least asking the person who Posted it for permission to use it...

As to their site - obviously constructed by some 14-yr old if the splash page is anything to go by.

so long as they are not giving the impression the testimonials are for the vendor, then cant see why its a problem. ok, in a perfect world you would be like to be "asked", but unless people put a copyright on the posts they makeit public domain and fair game. i think giving the source of quotes ie uk vapers was sufficient to stay the right side of ethical IMO

You are probably correct Nudger - The comments are probably Public Domain but then again, whilst anyone can join UK Vapers, it is ostensibly a Private (Members-only) Forum.

I have not read up on all of the Rules but there MAY be a clause about the copying of material on the Forum to sites outside the Forum - I'm sure the Moderators would know if that is the case.

At the end of the day it is not a "big deal" but it would still be nice to be asked - if for no other reason then the fact that someone "values" what you said...!!!

According to legal newsletters and seminars I've been to, your written words or works of art (like photos) are generally regarded as your property under UK law unless you agree to the contrary (by contract of employment, say, or through forum terms and conditions). The area of T&Cs that claim copyright are actually open to challenge if they are 'hidden away', changed after you signed up etc but in our case its pretty straightforward because UKVapers doesn't claim any copyright ownership over your words - merely a license to publish/display here.
Anyone who objects to this website using your monika and your words should not feel that they are being a spoilsport or anything imho. What the site has done is more than cheeky - its illegal.

Legitimate sellers would sign on here, post up a request for testimonials (like ECigWizard did, say) and get you to post on something they have some rights over - like their facebook page say.

I don't think too many people would be fussed, although I would prefer they'd asked permission first.

What I am absolutely LIVID about is the use of toys-r-us logo!!!

That's a childrens store and to link e-cigs and childrens toys together is diabolical. I've sent an email to toys-r-us pointing out the site. Hopefully it will be gone soon.

Thanks for clearing that up. I knew there was something in the Rules but didn't think it was what you have outlined. That being the case - they should be told to remove the articles I would imagine?

Yes they should be told - but the individuals who are quoted have to do the telling,, as UKV does assume copyright or IP for things posted by members.
