Vaping in Sheltered Accommodation

OK, So I've finally managed to persuade my Mother in Law (who is 78 and suffers from COPD) to cut down on her cigarettes (and hopefully eventually quit) by switching to vaping. She lives in sheltered accommodation (separate self contained flats with communal areas) and she was hoping that she'd be able to vape whilst playing bingo.


Unfortunately, the person in charge there has told her she can't vape in the communal areas "until they've looked into it". I've no idea what that means, but we are now trying to gather collateral together to persuade the council to let her vape in these areas. Has anyone had any similar experiences or does anyone have any advice / info we can use to make them see sense?

My concern is that the stance they've taken means the council are going to have to make a policy decision in order for her to be allowed to vape and that's not something they're likely to do...

I would just quote the legal side of the no smoking ban,

Chapter 28 part1,Chapter1, section1 Para2 of act states:

Smoking refers to smoking tobacco or anything which contains tobacco or smoking any other subatance: and smoking includes being in possession of lit tobacco or anything lit which contains tobacco. or being in possession of any other lit substance in a form in which it could be smoked.

Therefore electronic smoking products such as e-cig are exempt from this legislation because no tobacco is lit or used.

Then let them prove other wise.

Thanks for that - we're still trying to get them to say on what grounds they're not allowing it: It seems they're currently taking the position that they don't have legislation specifically allowing it so it's not allowed until they've made a decision.
To me that's crazy because they don't specifically allow people to drink water in the shared areas either (i.e. there's no rule that says drinking water is allowed), but it's obviously not banned.

I'll try quoting the regs to them and see what happens

they take the path of least resistance.. which means discourage it.. if it becomes too hard to do that they will permit it.. treat them like over protective mothers..

its an "unknown" to them.. whats the worse case scenario if she just quietly ignores them.. if its possible to get away with it that is what she should do..

if they really mean it they will take action if they dont as well might be the case she wins..

backing them up against a wall aint always the best solution..

Great news that your MIL is giving vaping a go i have cut down to 4 rollies a day i have COPD i had my spiroetry test a few days ago and have improved so tell your MIL to keep on vaping and i hope they let her enjoy her bingo while vaping

Give her something with a nice fruity flavour...when the others smell it , they'll all like it ( may work because it wont smell anything like fags )

Thanks for the advice everyone. The biggest problem is that she asked the question about if it was allowed: She'd probably have been better off just keeping quiet and waiting for someone to complain (she's not one for confrontation though)
She's only been vaping for a couple of weeks, but already seems to be showing signs of improvement. I tried to convert her before with a Titan, but she couldn't get on with the manual button. She recently saw my Liberro Realis and liked the fact that it looked like a cigarette and is automatic (plus the cartomizers are much better than the separate atties / carts) so she got herself one and loves it now :)

Its such a shame that your having such problems getting them to allow this!
They should be promtiong it! If all smokers realized how good e cigs were thered be no smokers!!!

Interesting stuff, I suppose it is not the legal side that needs working on right now (because we have to wait for the MHRA:( ), but the social side, if people see 'smoke' (that is actually relatively harmless vapour) they will probably be insulted. It seems that electronic smoking is tarred (pardon the pun lol) with the same brush as smoking, is still considered socially unacceptable :( There is so much of this, another example of the adoption of social norms in opposition to the legal stance is vaping on planes or trains.

I do hope people will come round with time, we all have to make a big effort to get the right public image off the bat, the more well planned exposure the better. Well done on the bingo front I wish you and your mother-in-law well!
